These terms apply in addition to any rights you may have under applicable consumer protection laws.

Ordering & Payment

• Order Confirmation: Orders are confirmed once payment of the required deposit or full purchase amount has been received.

• Pricing: All prices are displayed in the applicable currency and are subject to change without notice prior to order confirmation.

• Balance Payment: Any remaining balance must be paid before dispatch unless otherwise agreed in writing.

• Title: Ownership of the sauna remains with Kindra until the purchase price has been paid in full.

Delivery & Installation

• Delivery Access: Customers are responsible for ensuring suitable access for delivery and installation where applicable.

• Additional Access Costs: Any additional costs arising from difficult access, cranes, lifting equipment, site obstacles, restricted access, failed delivery attempts, or additional delivery requirements are payable by the customer.

• Delivery Timeframes: Estimated delivery dates are provided in good faith but may vary due to manufacturing, shipping, customs, weather, carrier delays, or other factors outside our reasonable control.

• Risk: Risk in the sauna transfers to the customer upon acceptance of delivery.

• Site Preparation: Customers are responsible for ensuring the installation site is suitable, level, structurally appropriate, and prepared in accordance with any guidance provided by Kindra.

• Electrical & Compliance: Customers are responsible for engaging suitably qualified tradespeople for electrical connections and for ensuring the sauna is installed and used in accordance with local laws, regulations, building requirements, and electrical standards.

Order Changes & Cancellations

While we will always do our best to accommodate changes, the following conditions apply:

• Order Changes: Requests to modify an order may not be possible once production has commenced.

• Cancellations: You may be able to cancel your order before final delivery for a deposit refund, less a $250 non-refundable processing fee. If Kindra has already incurred non-refundable, order-specific costs, such as import duties, taxes, freight charges, customs fees, payment processing fees, or other costs that cannot reasonably be recovered or applied to another order, the non-refundable amount may be higher. Where this applies, Kindra will provide reasonable evidence or receipts for those costs. We will always endeavour to minimise such costs where possible. Please contact us as soon as possible for any changes or cancellations.

• Custom Orders: Products manufactured or modified to a customer’s specific requirements may not be eligible for cancellation or refund once production has commenced, except where required by law.

Product Variations & Improvements

• Natural Materials: Timber is a natural material and may display variations in colour, grain, texture, density, movement, and appearance over time.

• Minor Variations: Minor variations in timber, colour, dimensions, hardware, finish, manufacturing methods, or product appearance do not constitute defects, including minor cosmetic dents or bumps.

• Product Improvements: Kindra may make reasonable product improvements, design refinements, or specification changes without notice, provided the product remains substantially consistent with the product ordered.

Product Use & Care

• Intended Use: Kindra saunas must be used in accordance with all supplied instructions, safety guidelines, and care requirements.

• Maintenance: Regular cleaning and maintenance are required to preserve the appearance, safety, and performance of your sauna.

• Outdoor Exposure: Outdoor products will naturally weather over time. Normal weathering, cosmetic changes, timber movement, surface checking, fading, and changes caused by environmental exposure are not considered defects.

Warranty

Kindra warranty coverage is subject to the separate Kindra Warranty Policy.

The warranty does not cover:

• normal weathering
• cosmetic changes
• misuse or neglect
• lack of maintenance
• improper installation
• unauthorised modifications
• unsuitable site conditions
• damage caused by external factors

Photos & Marketing

Unless you tell us otherwise, Kindra may request to photograph or document completed installations for internal records, product support, or quality assurance.

Design & Intellectual Property

All intellectual property rights relating to Kindra products, including designs, trade marks, imagery, product names, technical materials, product documentation, and marketing materials, remain the property of Kindra.

No rights are transferred to customers except as necessary for the normal personal use of the product.

Customers must not copy, reproduce, modify, reverse engineer, or commercially exploit any Kindra product, design, imagery, documentation, or intellectual property without our written consent.

Force Majeure

Kindra is not responsible for delays or failure to perform where caused by events outside our reasonable control, including:

• shipping disruptions
• customs delays
• port congestion
• strikes or labour shortages
• supplier delays
• natural disasters
• extreme weather
• pandemics
• government actions
• regulatory delays
• other circumstances beyond our control

Where such an event occurs, we will take reasonable steps to minimise disruption and keep you informed.

Limitation of Liability

To the maximum extent permitted by law:

• Indirect Loss: Kindra is not liable for indirect, incidental, consequential, or special damages arising from the purchase, delivery, installation, or use of its products.

• External Factors: We are not responsible for damage resulting from misuse, neglect, improper installation, unauthorised modifications, lack of maintenance, extreme weather events, unsuitable site conditions, or circumstances beyond our reasonable control.

• Consumer Rights: Nothing in these terms excludes, restricts, or modifies any rights or remedies available under applicable consumer protection laws.
